Terms and Conditions of Use

1. Provider identification

The services are provided by Próximo Rol SpA (hereinafter, "Próximo Rol", "we" or "the Company"), a stock corporation (SpA) incorporated under the laws of the Republic of Chile, Tax ID (RUT) 78.458.089-K, domiciled in Chile, contact email hello@proxicoach.com and website proximorol.com.

2. Definitions

• Platform (or ProxiCoach): the set of sites, web and mobile applications, and features operated by Próximo Rol SpA, described in Section 4.
• User: any natural person who accesses or uses the Platform, whether for free or paid.
• Account: the personal and non-transferable registration through which the User accesses the services and their history.
• Credits: consumption units that enable paid services (for example, a CV improvement or an interview).
• Plan: a recurring paid subscription (monthly or annual) granting expanded access to the services, subject to the fair-use policy.
• User Content: the data, text, résumés, voice recordings and other information the User provides or generates while using the Platform.

3. Purpose and acceptance

These Terms govern access to and use of the Platform. Using any service implies full and unreserved acceptance of these Terms. If you do not agree, you must refrain from using the Platform. To purchase paid services you must be over 18 and have the legal capacity to contract.

4. Description of services

Próximo Rol SpA operates ProxiCoach, a platform supporting job search and preparation. The available services are:

• Résumé: compatibility analysis against automated filters (ATS), a step-by-step guided builder, and AI tailoring of the résumé to a specific job opening, with PDF and Word download.
• Voice mock interview: personalized questions generated from the résumé and the role, transcription of the User's answers and an evaluation report.
• Practice: AI-assisted exercises for the STAR method, personal pitch and aptitude tests (logical and numerical).
• Get to know yourself: a personality profile based on the five-factor model (Big Five / IPIP-NEO), a professional self-portrait and archetype, produced from the User's activity on the Platform.
• Career timeline: a record of the User's trajectory, with AI support to build their professional narrative.
• Job-search management: target-company pipeline, application tracking, networking contacts, tasks and goals.
• Job catalogue and AI search: vacancies collected from public and third-party sources (see Section 4.1), ranked against the User's stated goal, with fit analysis, profile gaps, company research, cover letters and salary guidance.
• ProxiNote: a meeting copilot that transcribes a live conversation and suggests answers to the User (see Section 4.2).
• Reports and analytics: interview reports, a readiness index and tracking of the User's progress over time.

Not all services are available on every plan. Availability and limits per plan are set out on the plans page and in Section 7. We may offer modules in a testing phase, enabled selectively and subject to change or withdrawal.

4.1 Job catalogue

The catalogue gathers vacancies published by companies and by third-party recruitment systems, obtained through public interfaces, syndication feeds and provider agreements. The vacancies are not ours: we do not issue them, we are not party to the selection process, and we do not control their validity, accuracy or the conditions they offer. They may be closed, out of date or contain errors from their issuer. Applications always take place on the employer's site or that of its recruitment system, under their terms.

The catalogue, its ranking and the derived data we produce about it constitute a database owned by Próximo Rol SpA. Bulk, systematic or automated extraction is prohibited (see Section 10).

4.2 ProxiNote and recording of third parties

ProxiNote transcribes the audio of a live conversation —including the voice of the other participants— in order to suggest answers to the User. The Platform cannot give notice inside the call.

5. Registration and user account

To access paid services, the User must create an Account with truthful, accurate and up-to-date information. The User is responsible for keeping their credentials confidential and for all activity carried out from their Account.

The Account is personal and non-transferable. Sharing the Account, credits or plans among several people is prohibited. To protect the service, we may apply identity-consistency checks (for example, between the Account holder and the CV data) and suspend or close Accounts where there are signs of shared or fraudulent use.

6. Prices, credits and payments

Prices are shown on the Platform in euros (EUR) and include applicable taxes where relevant. The current plans are:

The price in force at the time of purchase is always the one published on the plans page and in the app itself. Where it differs from this section, the price shown during checkout prevails, as that is what is actually charged.

CV analysis against ATS filters is free and unlimited on every plan.

Credits. Some Users still hold credits purchased under the previous per-unit model. Those credits remain valid, are consumed before the plan's allowances and do not expire. No new credits are issued.

Payments are processed through Stripe, an external payment provider. Próximo Rol does not store full card data. The purchase is confirmed and credits or the plan are applied once Stripe notifies a successful payment. The User declares that the payment methods used belong to them or that they are authorized to use them.

7. Consumption and fair-use policy

To ensure a sustainable, quality service for everyone, we apply reasonable and transparent usage limits. Inside the app you can always see your balance and how many practices you have left before using them.

Free-plan trials are lifetime, not daily or monthly: they let you try each AI feature once. Browsing the job catalogue, filtering and ranking it, and managing your company and application pipeline consume no allowance and are free on a permanent basis.

Anyone buying the Express Application plan for the first time receives, at the same price and for the same duration, the allowances in the "Express (first time)" column. It applies once per account: any later purchase of the same plan follows the "Express (7 days)" column.

On the Express Application plan, allowances marked "in total" apply to the full seven-day window — they do not reset daily or monthly — and the interview report is delivered in full, including the personality archetype and the voice read.

The Personality (Big Five) module for teams and the progress Analytics module are available on Pro plans only.

Inside the app you can see your consumption and remaining allowance at any time. There is also a minimum interval between AI evaluations for security reasons. We may adjust these limits to protect the integrity, sustainability and availability of the service; the limits in force are always those published in the app, and any material change will be communicated in accordance with Section 19.

8. Plans, billing and renewal

8.1 Monthly plan

The monthly plan is billed in advance and renews automatically each month, charging the registered payment method, until the User cancels it. The User may cancel renewal at any time; access remains active until the end of the month already paid, and no further charges are made thereafter.

8.2 3-month Sprint

The 3-month Sprint is a one-off payment granting access to the Pro plan's features for three months. It does not renew automatically and creates no recurring charges: at the end of the period the Account returns to the Free plan unless the User purchases another plan.

8.3 Express Application (7 days)

Express Application is a one-off payment granting access for seven (7) days to the features described in Section 7. It does not renew automatically and generates no recurring charges: at the end of the period the Account returns to the Free plan unless the User purchases another plan. If, during that period — or within the fourteen (14) days following its end — the User purchases a higher plan, the amount paid for Express Application is deducted.

8.4 Annual plan (withdrawn, existing subscribers only)

The annual plan is a twelve (12)-month contract, paid for the year in advance, with a minimum commitment period equal to that year. The plan renews automatically at the end of each annual period unless the User turns off automatic renewal.

The User may turn off automatic renewal at any time from their account or by writing to hello@proxicoach.com; in that case, the plan will not renew and will end at the close of the annual period already paid. Termination of the annual contract takes effect once the contracted year has elapsed; during that period the User keeps access to the service.

9. Cancellation and refund policy

No refunds are issued once the month or the contracted service period has been paid. The services are provided and consumed immediately and digitally; by purchasing and starting to use the service, the User requests and consents to its immediate performance and acknowledges that, once performance has begun or the credit has been consumed, no refund applies.

Cancelling a plan stops future charges but does not entitle the User to a refund of the amounts corresponding to the current period already paid. Purchased credits are non-refundable and cannot be exchanged for money.

10. Acceptable use and prohibited conduct

The User agrees to use the Platform lawfully and in accordance with these Terms. The following is prohibited, by way of example:

• Automated access or use (bots, scraping, scripts) or any attempt to circumvent the fair-use limits or security controls.
• Bulk or systematic extraction, copying or reuse of the job catalogue, of its ranking or of any derived data we produce about it, as well as its incorporation into another database or service.
• Using ProxiNote to record or transcribe other people without having informed them beforehand and obtained their agreement (see Section 4.2).
• Reselling, sublicensing or commercially exploiting the services without written authorization.
• Sharing the Account, credits or plan with third parties.
• Uploading unlawful or defamatory content, content that infringes third-party rights, or personal data of others without their consent.
• Interfering with the security, integrity or availability of the Platform or third-party infrastructure.
• Reverse-engineering the Platform's components or logic.

Non-compliance entitles Próximo Rol to suspend or close the Account, without any right to a refund and without prejudice to any applicable legal actions.

11. Artificial intelligence and scope of results

Part of the services are generated using artificial intelligence models. The results (improved CVs, reports, evaluations, suggestions and transcriptions) may contain inaccuracies, omissions or inferences. The User is responsible for reviewing and verifying all content before using it, especially data such as figures, dates, team sizes or achievements.

Interview reports and evaluations are an initial, indicative assessment, not individual professional advice or a guarantee of performance or outcome. Próximo Rol is not liable for decisions made by the User or third parties based on such results.

12. Intellectual property

The Platform, its software, design, trademarks, texts, methodologies, rubrics and other elements are owned by Próximo Rol or its licensors and are protected by intellectual-property law. The User is granted no more than the license necessary to use the services in accordance with these Terms.

User Content remains owned by the User. The User grants Próximo Rol a limited, non-exclusive and revocable license to process such content solely to provide the services (for example, to analyze and improve the CV, or to generate the interview report).

13. Personal data protection (GDPR and Law 21.719)

Próximo Rol processes personal data in accordance with Chile's Law No. 21.719 on the protection of personal data and, where applicable to persons located in the European Union, with the General Data Protection Regulation (GDPR, EU Regulation 2016/679). The data controller is Próximo Rol SpA.

13.1 Data categories

• Identification and contact data: name, email, phone.
• Professional data: résumé, work history, education and other information provided.
• Voice data: the recordings and transcriptions of the mock interview. Voice may constitute sensitive personal data of a biometric nature, so its processing is carried out with the User's prior explicit consent, which may be withdrawn at any time.
• Third-party data supplied by the User: the transcripts ProxiNote generates from a conversation include the voice and words of the other participants. In respect of that data the User acts as controller and Próximo Rol SpA as processor on their behalf; it is for the User to hold the corresponding legal basis (see Section 4.2).
• Payment data: handled by Stripe; we do not store full card data.
• Usage and browsing data: via cookies and analytics tools.

13.2 Purposes and legal basis

• Provide and manage the contracted services (performance of the contract).
• Process payments and issue receipts (performance of the contract and legal obligation).
• Process voice to transcribe and generate the report (explicit consent).
• Improve the Platform and perform analytics (legitimate interest and/or consent).
• Send service communications and, if you authorize it, commercial communications (consent).

13.3 Retention

We keep data while the Account is active and, thereafter, for the applicable legal periods (for example, tax and defense against claims). Voice recordings and transcriptions are kept only as long as necessary to provide the service and may be deleted at the User's request.

13.4 Your rights

You may at any time exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, as well as withdraw your consent without retroactive effect, by writing to hello@proxicoach.com. We will address your request within the legal deadlines. You also have the right to lodge a complaint with the competent supervisory authority (in Chile, the Personal Data Protection Agency once operational; in the EU, the authority of your country of residence).

13.5 Minors

The Platform is intended for people over 18. We do not knowingly collect data from minors.

14. Processors and international transfers

To provide the service we rely on providers acting as data processors, subject to confidentiality and security obligations. Some may be located outside Chile or the EU; in such cases we apply the appropriate safeguards required by regulation (for example, standard contractual clauses).

The up-to-date list of processors, their purposes and the applicable safeguards is maintained in Section 7 of the Privacy Policy, which prevails over this table in the event of any discrepancy.

15. Information security

We apply reasonable technical and organizational measures to protect data against unauthorized access, loss or alteration. No system is infallible; the User contributes to security by keeping their credentials confidential and notifying us of any unauthorized use.

16. Availability and service changes

We aim for maximum availability, but the service may experience interruptions due to maintenance, technical causes or force majeure. We may modify, add or discontinue features to improve or protect the Platform. When a change materially affects a paid service, we will endeavor to notify it with reasonable advance notice.

17. Warranties and limitation of liability

The services are provided "as is" and "as available". To the maximum extent permitted by law, Próximo Rol does not warrant that results are accurate, complete or fit for a specific purpose, or that the Platform is free of errors or interruptions.

To the extent permitted by applicable law, Próximo Rol's total liability to the User on any basis is limited to the amount actually paid by the User in the last twelve (12) months for the service giving rise to the claim. Próximo Rol will not be liable for indirect or incidental damages, loss of profit or loss of opportunity. Nothing in these Terms excludes liabilities that cannot be limited by law, including consumers' mandatory rights.

18. Indemnity

The User will hold Próximo Rol harmless against third-party claims arising from misuse of the Platform, breach of these Terms or the User's infringement of third-party rights.

19. Amendments to the terms

We may update these Terms to reflect legal, technical or service changes. The version in force will always be the one published on this page, with its update date. Continued use after changes are published implies acceptance; if a change is material, we will endeavor to notify you.

20. Term and termination

These Terms apply while the User maintains an Account or uses the Platform. The User may terminate the relationship by closing their Account, subject to plan conditions and the refund policy. Próximo Rol may suspend or terminate access in the event of breaches, in accordance with these Terms.

21. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the competent courts of Chile, without prejudice to the non-waivable rights that consumer-protection or data-protection legislation grants the User in their country of residence. If any clause is declared invalid, the remainder will retain full force.
